Back emergency exit window

The latch on my back emergency window has broken twice. I have never used/opened the window. I paid for the replacement part the first time. This time the hinge itself is bent. The window cannot be closed completely now. I am told that the window must be replaced at a cost of $1,200. My Redwood is four years old. Has anyone had a problem with the latch braking? Since the part has never been used, is it still under warranty?

Cant you just replace the hinge on the window that would seem like the best way to go on this.

My latch broke twice also, the last replacement handle is still in the package & window is wired shut, it would be much easier to get out at the one at the end of the couch anyway.
